1. Definitions

All competition winners will be drawn at Level 7, South Wharf Tower, 30 Convention Centre Place, South Wharf VIC 3006 on the dates and times advised in Appendix 1.1. All valid entries will be included in the draw.
The prize(s) for the competitions and the value of the prize(s) are listed in Appendix 1.1. Where the prize is an e-gift card, it is issued to you by True Rewards Pty Ltd and is subject to issuer terms and conditions here. The e-gift card is valid until the expiry date specified on the gift card or by the gift card provider. The gift card is not transferable or redeemable for cash. We will not be responsible for any gift card that is lost or stolen. The prize is subject to the terms and conditions of the chosen retailer.
The winner will be notified in writing within 14 days of the draw. The prize will be delivered, paid or transferred to the winner within 28 days after the prize draw date. We will make reasonable efforts to identify and locate the prize winner.
The names of winners of prizes will be published here (our website) within 30 days of the draw, for a minimum of 28 days.
If the prize (other than perishable prizes) remains unclaimed 3 months after the prize draw date, an unclaimed prize draw will be held on that date (or next business day) at Level 7, South Wharf Tower, 30 Convention Centre Place, South Wharf VIC 3006 at the same time as the original draw (advised in Appendix 1.1) subject to the approval of any necessary regulatory authority. The winner of the unclaimed prize draw will be notified in the same manner as set out in this clause 2.
We assume no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, we may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the competition.

In the event that the prize (or any part of the prize) becomes unavailable for reasons beyond our control, subject to relevant State and Territory legislation, we may substitute a prize (or the relevant part of a prize) with a prize of equal or higher value and the winner will be notified accordingly. c. Winners and Awards

We accept no responsibility for any variation in the prize values. The prize values are stated in Australian dollars as at the time of publication of the competition. We accept no responsibility for any tax implications that may arise from the prize winnings and all entrants are responsible for their own financial situation as a result of any prize or winnings. i. The winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by us. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, we (including our officers, employees and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the competition, including, without limitation:
a. any technical difficulties or equipment malfunction (whether or not under our control);
b. any theft, unauthorised access or third-party inference;
c. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by us) due to any reason beyond our reasonable control;
d. any variation in market value to that stated in these terms and conditions;
e. any tax implications; or
f. the prize or use of the prize.
ii. A) Competition Entry. To enter the competition, during the competitional period you must register to participate in the SG Fleet 2023 Footy Tipping Competition by providing the details requested.
B) Who Can Enter. Entry into the competition is open to employees of invited SG Fleet clients only.
C) Who Cannot Enter. All persons under 18 years of age; residents of the ACT; and persons who are not legal residents of Australia. Directors, management, employees and their immediate families of SG Fleet, associated entities and its agencies associated with this competition are ineligible to enter.
D) Entry Fee. There are no entry fees to register or play.
E) Promotional Material. Upon registration, entrants agree to receive promotional & marketing material from the promoter.
F) Privacy Policy. All personal information collected by entering this competition will not be given/sold to any third party under any circumstances unless required by law.
G) Competition Start and Finish. The competition commences prior to the first round of the Home and Away season and concludes upon the completion of the final game of the Home and Away season.
H) Entering After the Official Start Date. Entrants who register after the cut-off time for Round 1 of the Home and Away season will be awarded the default tips for the rounds they missed of Average Score in Round.
I) Communication During the Competition. All communication between the promoter and the entrant must be via the promoter's website and electronic mail. Registration forms or weekly tips sent to the promoter via any other means of communication are void.
J) Administration of the Competition. The promoter may email the results for each round to each participant and email reminder messages to the participant to lodge tips before cut-off times. The promoter will not be held responsible for any emails that are not delivered to any participant. Participant should not rely on any reminders from the promoter.
K) Tips Lodgement. Tips can only be entered into the competition through the tipping competition website. The promoter takes no responsibility for your inability to access the competition website or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, we may (where necessary) modify, cancel, terminate or suspend the competition.
L) Points Allocations.

ii) Participants cannot select a draw as a possible outcome. A draw is treated as a win for all participants regardless of which team they selected or were allocated by the competition's default tips.
M) Weekly Cut-Off Times. Tipping is closed on a game-by-game basis 10 minutes before each game. Tips entered before the deadline may be amended provided the changes are completed prior to cut-off.
N) Default Tips. Participants who fail to enter tips will be awarded the default tips of Away Teams with a default predicted winning margin of 99.
O) Weekly Prizes are eGift cards (value $100). The weekly prize is awarded to the competitor with the most number of correct tips whose predicted tie-breaker is most accurate. A prize is awarded every week. If more than one tipper qualifies then the weekly prize will be awarded to the competitor who completed their tips on the earliest occasion.
If a tipper does not enter all tips for a round, then they cannot qualify for the weekly prize. Prizes can only be awarded to participants who are still employed by an invited SG Fleet client at the time of the prize being awarded.
P) End of Season Prizes – an eGift card to the value of: 1st Prize – $2,500; 2nd Prize – $1,500; 3rd Prize – $1,000. Prizes can only be awarded to participants who are still employed by an invited SG Fleet client at the time of the prize being awarded.

Q) Determining the Overall Winners. In the event of a tie for any prize, the entrant with the lowest accumulated margin difference will be the winner. Each round the variance of each entrant's margin prediction from the actual margin will be calculated. The accumulated total of this variance will be used in the tie-breaker calculation. If after examining the total variance, a final winner cannot be determined in each prize category, the tipper who registered on the earliest date and time will be determined the winner.
R) Date, Place and Time of Determining the Winner(s). The winner(s) of each weekly prize will be determined by 12 noon on the day following the final game of each round of the tipping competition, at the Melbourne offices of the Administrator of the competition (Level 7, South Wharf Tower, 30 Convention Centre Place, South Wharf VIC 3006) and will be notified and delivered their prize by electronic mail by 5pm on that day.
The winner(s) at the end of the season will be determined by 12 noon on the Wednesday following the final round of the tipping competition, at the offices of the Administrator of the competition and will be notified and delivered their prize by electronic mail by 5pm on that day. The winner’s names will be displayed on the competition website and published here (our website) within 30 days of the draw, for a minimum of 28 days. We will make reasonable efforts to identify and locate the prize winner.
The right to the prize shall be forfeited if:
i) it remains unclaimed 28 days after notification has been provided;
ii) it is won by a participant who is no longer employed by an invited SG Fleet client at the time of the winner being determined.
The prize will be issued to the next participant who qualifies, who will be notified in the same manner as set out in this clause R.
S) Dispute Resolution. In the event of a dispute, the decision of the promoter is final. No responsibility is taken for lost, or misdirected, registrations and/or weekly tips.
T) Amendment of Rules. The promoter reserves the right to amend the rules of the competition from time to time as considered necessary. Individual notice of such changes shall not be given but such changes will be recorded on the competition website.

2. Competition Rules
a. Rules for this competition
These Competition Rules are specific to this competition and include information on eligibility to enter and how to enter the competition. By entering this competition, your entry constitutes acceptance of our Competition Terms, including the Competition Rules specific to this competition.

The competition start and end dates and times are listed in Appendix 1.1 below. No entries will be accepted outside of these dates and times.
Directors, management, employees and their immediate families of SG Fleet, associated entities and its agencies associated with this competition are ineligible to enter.
At the time of lodging your Entry Content you must be:
Only one entry permitted per person.
All competition winners will be drawn at Level 7, South Wharf Tower, 30 Convention Centre Place, South Wharf VIC 3006 on the dates and times advised in Appendix 1.1. All valid entries will be included in the draw. To be eligible to win, the entrant drawn must still be subscribed to SG Fleet Group marketing communication at the time of the prize draw.
The prize(s) for the competitions and the value of the prize(s) are listed in Appendix 1.1. Where the prize is an e-gift card, it is issued to you by True Rewards Pty Ltd and is subject to issuer terms and conditions here. The e-gift card is valid until the expiry date specified on the gift card or by the gift card provider. The gift card is not transferable or redeemable for cash. We will not be responsible for any gift card that is lost or stolen. The prize is subject to the terms and conditions of the chosen retailer.
The winner will be notified in writing within 14 days of the draw. The prize will be delivered, paid or transferred to the winner within 28 days after the prize draw date. We will make reasonable efforts to identify and locate the prize winner.
The names of winners of prizes will be published here (our website) within 30 days of the draw, for a minimum of 28 days.
If the prize (other than perishable prizes) remains unclaimed 3 months after the prize draw date, an unclaimed prize draw will be held on that date (or next business day) at Level 7, South Wharf Tower, 30 Convention Centre Place, South Wharf VIC 3006 at the same time as the original draw (advised in Appendix 1.1) subject to the approval of any necessary regulatory authority. The winner of the unclaimed prize draw will be notified in the same manner as set out in this clause 2.
We assume no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, we may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the competition.

3. General
From time to time, we run competitions through our website, and other forums. We encourage you to carefully review the individual competition requirements and details (“Competition Rules”) for each competition before registering or submitting an entry since each competition may have unique eligibility requirements, methods of entry, content and technical requirements.
If there are any inconsistencies between the clauses in these Competition Terms and the specific Competition Rules, these Competition Terms will govern.
By entering any competition, you agree to the Competition Terms and Competition Rules for each competition in which you choose to participate. The Competition Rules may vary for each competition and you are required to read the Competition Rules for each competition before you participate.
a. Entry Content
i. Entry details will be used for the purposes of conducting this competition or for competitional and marketing purposes (including for direct marketing) in accordance with our Privacy Policy (available at https://www.sgfleet.com/au/policies/privacy-policy). By entering this competition, you consent to the use of your personal information (including name, address, telephone number, email and image and photograph(s)) for these purposes, and that we may contact you for future marketing and material purposes without compensation.
ii. Our decision is final, and no correspondence will be entered into. We accept no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
iii. Should your contact details change during the competition period, it is your responsibility to notify us. A request to access or modify any information provided as part of the redemption of a prize should be directed to us.
iv. We reserve the right to request verification of your social media profile and of the age, identity and residential address of the winner and any other information relevant to entry into or participation in this competition. Verification is at our discretion, which decision is final. Failure by us to enforce any of our rights does not constitute a waiver of those rights.
v. We reserve the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this competition, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
b. Prizes
i. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Each prize is not transferable to another person (unless agreed to by us in writing) or exchangeable for other goods and services and cannot be redeemed for cash. Any whole or part of a prize that is unused will be forfeited.
ii. We do not guarantee the availability of prizes advertised through our website, newsletter emails, or other methods of advertising that we have adopted. In the event that the prize (or any part of the prize) becomes unavailable for reasons beyond our control, subject to relevant State and Territory legislation, we may substitute a prize (or the relevant part of a prize) with a prize of equal or higher value and the winner will be notified accordingly. We recommend that before entering any competition, survey or other activity posted on our site or associated newsletter emails, you should verify any important information, such as the Competition Rules.
c. Winners and Awards
i. Winning Entrants will be notified in writing in accordance with the Competition Rules, using the contact information provided by the Entrant. We are not responsible for any incorrect addresses, prizes or awards that are not received as a result of any incorrect address or for any other error on the part of the Entrant.
ii. Prizes that are physical products must be picked up and/or shipped by the date specified in Competition Rules. Prizes that are digital and will be emailed to the email address provided during the competitional period.
iii. The outcome of the prize draw is final and binding. No correspondence or discussions will be entered into about the winner or individual entries.
d. Taxes
We accept no responsibility for any variation in the prize values. The prize values are stated in Australian dollars as at the time of publication of the competition. We accept no responsibility for any tax implications that may arise from the prize winnings and all entrants are responsible for their own financial situation as a result of any prize or winnings. Your own independent financial advice should be sought.
4. Limitation of liability
i. The winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by us. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, we (including our officers, employees and agents) exclude all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the competition, including, without limitation:
a. any technical difficulties or equipment malfunction (whether or not under our control);
b. any theft, unauthorised access or third-party inference;
c. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by us) due to any reason beyond our reasonable control;
d. any variation in market value to that stated in these terms and conditions;
e. any tax implications; or
f. the prize or use of the prize.
ii. If for any reason beyond our reasonable control this competition is not capable of running as planned, we reserve the right in our sole discretion to take any action that may be available to us, and to cancel, terminate, modify or suspend the competition, unless to do so would be prohibited by law.
iii. We reserve the right to cancel, terminate, modify or suspend the competition or amend these terms and conditions, subject to any directions from a regulatory authority.
